Although not truly vintage, i sold this (http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=280024696657&sspagename=ADME:B:AAQ:US:1) on ebay a few days ago. After they receive it I get this email from the buyer, "The add specifically says that this is a new FAO exclusive imperial shuttle (by Hasbro), this is a fraudulent misrepresntation of what arrived. You claim to have inspected the contents yet the contents of the package is clearly a 1984 Kenner, a 22 year old version of what I expected to get. You can resolve this issue by refunding me half of my money or I can settle this through ebay and the public forum. I communicated to you before that I am an attorney, so I suggest you make this right before I bring into a court in Florida under teh long arm statute to resolve this.

This guy is totally misinformed anyone have any suggestions how to handle it?

What did you send him? an FAO shuttle or a vintage one?

That's truly funny. He should know better than to start throwing around his profession before he does any research http://threads.rebelscum.com/images/graemlins/smile.gif I'd suggest you inform him as to why he is wrong and send him a few links to why. Florida has a pretty broad long arm statute so its better to simply show him wrong before you have to waste your time here.

I sent him the FAO one, does it have Kenner markings and 1984 date stamp? I never bothered to look.

In my experience dealing with people who claim that they are a lawyer are only trying to do it to scare you. The guy probably is a petroleum transferal engineer.

Weird. I went to floridabar.org and didn't find this guy. I also wento to the law firm's website and didn't see Mr. Owens either. Maybe I'm just missing it but Randy might be on to something...

Well he did put "law" into his ebay ID, so who knows for sure. I'd just send him links of photos of the old and new Shuttles so he can see for himself and be done with it.

That there sounds like extortion. Not wise for a career law man to be caught breaking it. If he does file soemthing through eBay make sure they get copy of his extortion email.

He's not listed on the Gordon Hargrove & James, P.A. website as an attorney.

Just tell him to go ahead and bring you in under the 'long arm statue'. He'd be the biggest laughing stock in the firm for trying to bring someone in from out of state because 'the victim' thinks he got sent the wrong plastic toy!

Not to mention the 'long arm statue' doesn't allow what he is proposing. There has to some significant proven damages.

"The legal test is whether the out-of-state defendant has contacts within the state which are "sufficiently substantial." An accident or injury within the state usually shows such a substantial contact. This is particularly important when a driver from one state is sued in another state for damages caused by his/her negligence there. It also can be employed if a product shipped from out-of-state fails, explodes or causes damage to a local person who sues in the state where he/she resides."

Trials cost money, 90 dollars is about what I charge for an hour of my work in here so either he is a very small time lawer or he has no idea of what a trial will cost him,

the only problem that I see is the bad feedback that he might left on you.
just block his nick for further auctions.

I'd love to know where the guy did his legal training. I would have thought that a lawyer would have to possess a mastery over both the written and spoken word...

This guy didn't go to law school...sounds more like he went to Hamburger U.
